Tax Evasion Prevention Policy Template
A policy template committing not to facilitate tax evasion in any form, with the reasonable and proportionate prevention procedures an organisation keeps in place to stop anyone acting on its behalf from facilitating tax evasion.
The policy has Approved By and Date Approved fields and carries a Public information classification, so it can be shared with workers, clients and other interested parties.
What the Tax Evasion Policy Covers
- Policy statement - no facilitation of tax evasion, complying with tax laws, and paying the right amount of tax
- Records - good records of transactions, receipts for cash transactions, and correct VAT details on invoices
- Zero tolerance - reported instances investigated in full and action taken
- Risk assessment - the risk of workers, sub-contractors and agents facilitating tax evasion assessed
- Prevention procedures - payments only against valid invoices to the supplier's own account, limits on cash, refusing requests to alter invoices or split payments, and contract terms for sub-contractors and agents
- Due diligence - on new workers, sub-contractors and suppliers, proportionate to the risk
- Reporting concerns - through the whistleblowing procedure, without fear of reprisal
- Communication and training - at induction and through toolbox talks, with extra training for finance, payroll and purchasing roles and attendance recorded
- Monitoring and review - internal audit, and a review at least once a year or when the law changes
Two Versions Supplied
The main policy is generic and does not name legislation. P-42 Tax Evasion and Criminal Finances Act Compliance Policy (V2) names the Criminal Finances Act, adds a construction industry scheme item for sub-contractor payments and a legislation section, and is the version to use for Common Assessment Standard uploads.
Written for the Common Assessment Standard
The risk assessment, prevention procedures, due diligence, reporting, communication and training and monitoring sections cover the points the Common Assessment Standard (CAS) question set asks for on preventing the facilitation of tax evasion.
Using the Policy
Add your company name and logo, check each commitment matches what your organisation does and edit any that do not, then approve and date the policy and share it with workers and anyone else who needs to see it.
Who Needs a Tax Evasion Prevention Policy?
Organisations completing Constructionline, SSIP or Common Assessment Standard applications, and any organisation that wants to show it has prevention procedures in place for the people who act on its behalf.
Included in the ISO 9001 Toolkit
This policy is part of the ISO 9001 Toolkit and is also included in the ISO 14001 and ISO 45001 toolkits and every alphaZ ISO toolkit that combines them.
